Warranty
This warranty is given free of charge by Tread Smart Tyres Limited (NZBN 9429053066596) ("Tread Smart", "we", "us") to the person who purchases a tyre from treadsmarttyres.co.nz for their own personal, domestic or household use ("you").
This warranty is additional to, and does not limit, exclude, or replace, your rights under the Consumer Guarantees Act 1993. Those rights continue to apply in full regardless of anything in this warranty, including where a fault falls outside what this warranty covers, and including after this warranty's 2 year term has ended.
1. What this warranty covers
We warrant that, for 2 years from the date your tyre is fitted (or, where you did not have it fitted through us, 2 years from the date of delivery), your tyre will be free from genuine faults in manufacture, meaning a defect that was present in the tyre at the time it was supplied and that was not caused by anything that happened afterward.
2. What this warranty does not cover
- accidental damage;
- road hazard damage, including punctures, impacts, cuts and kerbing;
- normal wear from use, including tread wear;
- damage caused by incorrect fitting, balancing, repair, or maintenance carried out by a third party;
- damage caused by underinflation, overinflation, overloading, or use outside the tyre's rated specification for your vehicle;
- cosmetic marks that do not affect the performance or safety of the tyre; and
- tyres that have been altered, repaired other than by a suitably qualified fitter, or used other than for their intended purpose.
Nothing in this list affects your separate rights under the Consumer Guarantees Act 1993 for a fault that falls outside this warranty's scope. This list describes what our own additional promise covers, not the full extent of your legal rights. If you did not buy your tyre for personal, domestic or household use, this warranty may not apply to you, but your rights under the Consumer Guarantees Act 1993 depend on the nature of the goods, not on why you bought them, and may still apply. 3. Making a claim
- Email us at info@treadsmarttyres.co.nz with your proof of purchase, a description of the fault, and photos of the tyre showing the fault.
- We may ask you to make the tyre available for inspection. Where we need input from the tyre's manufacturer or an independent assessor, we will arrange that ourselves as part of assessing your claim. You will never be asked to contact the manufacturer, a repairer, or any other third party yourself as a condition of making a claim.
- We will let you know the outcome of your claim within a reasonable time of receiving everything we reasonably need to assess it.
4. If your claim is accepted
Where a claim is accepted under this warranty, we will, at our reasonable discretion having regard to the circumstances, repair the tyre, replace it with an equivalent tyre, or provide a proportionate refund. Where we repair or replace your tyre, the replacement or repaired tyre is covered for the remainder of the original 2 year term, not a new 2 year term starting again, unless we tell you otherwise in writing. Where a replacement is provided, we will cover the cost of the Tyrewise stewardship fee and any freight or delivery cost associated with the replacement; you will not be charged again for either.
5. Your other rights
This warranty sits alongside, and does not replace, your rights under the Consumer Guarantees Act 1993, which cannot be excluded or limited for a consumer purchase. If a fault does not fall within what this warranty covers, you may still have a claim under the Consumer Guarantees Act 1993 or otherwise at law, and nothing in this document is intended to suggest a claim under this warranty is a required first step before you rely on those rights.
6. This warranty applies in New Zealand
This warranty is governed by New Zealand law and applies to tyres purchased for delivery within New Zealand. Nothing in this warranty, including this clause, limits, excludes, or is intended to be read as limiting or excluding, your rights under the Consumer Guarantees Act 1993 or any other New Zealand consumer protection law.
